MINIMUM ADVERTISED PRICE (MAP) POLICY

1. PURPOSE OF THIS POLICY

FIREGIN has established this Minimum Advertised Price (MAP) Policy to:

  • Protect brand integrity and premium positioning

  • Ensure fair competition among resellers

  • Prevent price erosion and race-to-the-bottom discounting

  • Support long-term brand growth for all partners

This policy applies to all authorized resellers, including retailers, gyms, distributors, and online sellers.

2. MAP POLICY OVERVIEW

The Minimum Advertised Price (MAP) is the lowest price at which FIREGIN products may be advertised to the public.

This includes, but is not limited to:

  • Websites

  • Online marketplaces

  • Social media posts

  • Email marketing

  • Digital ads

  • Printed advertisements

  • SMS promotions

MAP applies only to advertised prices — not the final selling price.

3. MAP PRICING GUIDELINES

  • FIREGIN will establish MAP pricing by SKU and may update it periodically.

  • MAP pricing will be communicated directly to authorized partners.

  • Resellers may sell above MAP at their discretion.

Discounts, rebates, or incentives that effectively advertise a price below MAP (including “instant rebates,” “automatic cart discounts,” or “strike-through pricing”) are considered MAP violations.

4. EXCLUSIONS FROM MAP

The following are not considered MAP violations:

  • In-store pricing not visible to the public

  • Final prices shown only after checkout

  • Loyalty rewards not publicly advertised

  • Membership-based pricing (approved by FIREGIN)

  • Private B2B quotes or invoices

5. UNAUTHORIZED SALES CHANNELS

Resale of FIREGIN products on unauthorized marketplaces (including but not limited to Amazon, Walmart, eBay, or international platforms) without written approval is strictly prohibited.

Unauthorized resale is grounds for immediate termination of reseller status.

6. ENFORCEMENT POLICY

FIREGIN will enforce this MAP Policy at its sole discretion.

Enforcement actions may include:

  1. Written warning

  2. Suspension of wholesale pricing or shipping benefits

  3. Order cancellation

  4. Termination of reseller or B2B membership

  5. Loss of territory or exclusivity

Repeated or intentional violations may result in immediate termination without further notice.

7. NON-NEGOTIATION & UNILATERAL POLICY

This MAP Policy is unilateral and non-negotiable.

  • FIREGIN does not seek agreement or assurance of compliance.

  • FIREGIN will not discuss pricing strategy or enforcement decisions.

  • No employee or representative of FIREGIN is authorized to modify this policy orally.

8. POLICY MODIFICATIONS

FIREGIN reserves the right to:

  • Modify MAP pricing

  • Update enforcement procedures

  • Amend this policy at any time

Changes will be communicated when applicable.

9. NO IMPLIED RIGHTS

This MAP Policy:

  • Does not constitute a contract

  • Does not create any rights or obligations beyond those expressly stated

  • Does not limit FIREGIN’s right to select or terminate resellers

10. GOVERNING LAW

This Policy is governed by the laws of the State of California, USA, without regard to conflict-of-law principles.
